Environment and its Laws

It is true that ever since man started to learn to use fire environmental problems has been seen. Even in this silicon age, though we have gained better skills and techniques of living, we are still a prey to these pollution. 


Emission of CFC Gases and other toxic gases in air has given rise to depletion of ozone layer which in turn has led to global warming. Immense use of cars, air conditioner and other gadgets have been the main source of these polluting gases. Most of the people are getting accustomed to gadgets and thereby have lost their connection with the natural environment.


Article 21 of the Constitution states “No person shall be deprived of his life or personal liberty except according to a procedure established by law.” It is not a mere right to live but it is our fundamental right to live with human dignity. This also accounts in the right to live in a fresh environment, free from pollution. 


The dominant factors which are responsible for environmental deterioration throughout the world are industrialisation, urbanisation, population explosion, poverty, over-exploitation of resources, depletion of traditional resources of energy and raw materials and research for new sources of energy and raw materials.


Indian Judiciary has been actively looking over the environmental issues for a long time and has been able to provide us with some landmark judgments which are well-known to most of us. One of such notable judgments of the Supreme Court is Sri Sachidananda Pandey v. State of West Bengal AIR 1987 SC 1109. The Apex Court in this case has observed:
"While the scientific and technological progress of man has invested him with immence power over nature, it has also resulted in unthinking use of power, encroaching endlessly on nature."

The way forward is to use our resources wisely and less use of highly polluting gadgets and making a moral duty to protect the environment. Article 51A(g) has given us the fundamental duty "to protect and improve the natural environment including forests, lakes, rivers and wild life, and to have compassion for living creatures."


Thus we may conclude that it is not only our fundamental right to live in a fresh environment but it is also our fundamental duty to protect the same for the use and benefit of the coming generations.
